Terms & Conditions
The terms that apply when you buy from Blaanc, online or in our Warriewood showroom. They sit alongside your rights under the Australian Consumer Law.
About these terms
These terms apply to every purchase you make from Blaanc Pty Ltd, ABN 89 655 410 861 (we, us or our), whether through blaanc.com.au (our Site) or in our showroom.
By placing an order, you agree to these terms together with our shipping policy, returns and exchanges policy and privacy policy. Your use of our Site itself is covered by our terms of service. Please read them before you order.
Your consumer rights
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law, or any other law that cannot be excluded. If any part of these terms appears to do so, it does not apply to the extent of that conflict.
Pricing
Prices are shown in Australian dollars and include GST where applicable. Prices may change at any time, but a change will not affect an order we have already accepted.
We take care to make sure our prices are accurate, but mistakes can happen. If we discover an error in the price of an item you have ordered, we will contact you as soon as possible and give you the choice of reconfirming at the correct price or cancelling for a full refund. If we cannot reach you, we will treat the order as cancelled and refund you in full.
Delivery charges are shown at checkout. This includes most bulky items, which are calculated by shipping weight and delivery region. Very large orders over 100 kg, and orders over 50 kg delivered to WA, NT or TAS, are quoted separately, as explained in our shipping policy.
Orders and acceptance
When you place an order, we will email you to confirm we have received it. This confirmation is not our acceptance of your order. Your order is accepted, and a contract formed, when we email to confirm it has been dispatched, or that it is ready for click and collect.
We may decline or cancel an order before it is accepted, for example if payment cannot be authorised, an item is out of stock, we suspect fraud, or there is a pricing error. If we do, we will let you know and refund any payment in full.
By placing an order, you confirm that you are at least 18 years old, that the details you provide are accurate, and that you are authorised to use the payment method you have chosen.
Payment
Payment is due in full at the time of ordering, using any of the payment methods offered at checkout. Payments are processed securely by Shopify Payments and our payment partners.
For orders where freight is quoted separately, freight is invoiced once we have confirmed the cost with you, and must be paid before your order is dispatched.
Product availability
All orders are subject to availability. If an item becomes unavailable after you have ordered, we will let you know as soon as possible. Where it makes sense, we may suggest an alternative of equal or higher quality and value. If you would prefer not to take it, we will refund you for that item in full.
We may change or discontinue products on our Site at any time.
Product information
We work hard to describe and photograph our products accurately. Colours can look different from screen to screen, and many of our pieces are made from natural materials such as timber, stone, linen and ceramic, so small variations in grain, tone and texture are part of their character rather than a fault.
Measurements are provided as a guide, so please check them carefully against your space before you order. If you are unsure about anything, get in touch and we will happily help.
Delivery, risk and ownership
Delivery timeframes and costs are set out in our shipping policy. Timeframes are estimates, and while we do our best to meet them, delays caused by carriers or events outside our control can occur.
Responsibility for your order passes to you once it is delivered to the address you gave us, or collected from our showroom. Ownership passes to you once we have received payment in full, including any freight charges.
Returns and refunds
Our returns and exchanges policy explains how to return an item, our change of mind policy, and what happens if something arrives faulty or damaged.
Promotions and discount codes
Promotions and discount codes are subject to their stated conditions, can only be used once per order unless stated otherwise, and cannot be exchanged for cash. Unless a promotion says otherwise, codes cannot be combined and do not apply to exit store, samples and seconds, or freight.
Trade and commercial orders
Trade, commercial and wholesale purchases may be subject to separate terms, which we will provide to you. Find out more on our trade and commercial page.
Our liability
To the extent permitted by law, including the Australian Consumer Law, our liability for a failure to comply with a consumer guarantee for goods that are not of a kind ordinarily acquired for personal, domestic or household use is limited, at our option, to replacing or repairing the goods, supplying equivalent goods, or paying the cost of doing so.
Otherwise, and to the extent permitted by law, we are not liable for any indirect or consequential loss, including loss of profit or income, arising from your purchase. Nothing in this section limits your rights under the Australian Consumer Law.
Events outside our control
We are not responsible for any delay or failure to meet our obligations caused by events outside our reasonable control, such as natural disasters, extreme weather, carrier or postal disruptions, industrial action, supplier shortages, pandemics, government action or internet and system outages. If this happens, we will let you know and do our best to minimise the impact on your order.
General
Governing law
These terms are governed by the laws of New South Wales, Australia, and you and we submit to the jurisdiction of its courts. This does not stop you from relying on consumer protection laws that apply where you live.
Changes to these terms
We may update these terms from time to time by posting a new version on this page. The terms in place at the time you place your order will apply to that order.
Severability
If any part of these terms is found to be invalid or unenforceable, the rest of these terms will continue in full force.
Relationship
Nothing in these terms creates a partnership, joint venture, agency or employment relationship between you and us.
